ARTICLE 1 - PARTIES

ARTICLE 2 - SUBJECT AND SCOPE OF THE AGREEMENT  

This contract regulates the rights and obligations of the parties regarding the sale and delivery of the products ordered by the Buyer from the tr.apesan.co website, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation .  

ARTICLE 3 - BASIC CHARACTERISTICS AND PRICE OF THE PRODUCTS SUBJECT TO THE CONTRACT  

The type, quantity, brand/model, color, sales price and payment information of the products subject to the contract are specified below:

ARTICLE 4 - DELIVERY CONDITIONS  

4.1. The ordered product( s ) will be shipped within 10 business days after the payment is completed . 
4.2.The products are delivered to the address specified by the Buyer during the order. 
4.3. In case of delays due to force majeure or logistics, the Buyer will be informed and, if requested, the order will be canceled and the payment will be refunded within 7 business days.  

ARTICLE 5 - RIGHT OF WITHDRAWAL AND RETURN CONDITIONS  

5.1. The buyer may return the product by exercising the right of withdrawal within 14 days from the date of receipt. can. 
5.2. For the right of withdrawal to be valid:  

  • The product must be unused,  

  • The original packaging must be undamaged,  

  • The product must be returned with the invoice and all accessories.  

5.3. In case of exercising the right of withdrawal, the product shall be returned by the Buyer to the address specified by the Seller . should be sent. 
5.4. If the right of withdrawal is exercised, the return shipping costs will be covered by the Buyer. However, if the product is defective or faulty, the return shipping costs will be covered by the Seller.  

5.5. After the returned product is examined by the Seller, a refund will be made within 10 business days.  

ARTICLE 6 - BUYER'S LIABILITIES  

6.1. The Buyer accepts that the information provided during the order is correct. 
6.2. The buyer must check the product before receiving it and report any damaged or missing products to the cargo officer . 
6.3. The Buyer agrees to use the product in accordance with the law and the instructions for use unless he/she exercises his/her right of withdrawal.  

ARTICLE 7 - SELLER'S LIABILITIES  

7.1. The seller is obliged to deliver the order on time and in full. 
7.2. The Seller has the right to cancel the order by informing the Buyer for products that cannot be delivered due to supply or stock problems.  

ARTICLE 8 - DISPUTE RESOLUTION  

In disputes arising from this contract, the Consumer Arbitration Committees and Courts where the Buyer or Seller is located are competent.  

ARTICLE 9 - CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA  

9.1. The Buyer's personal data are protected within the framework of the Personal Data Protection Law No. 6698. 
9.2. The Buyer can learn how his/her personal data is processed from the KVKK Information Text and Privacy Policy available on the tr.apesan.co website .  

ARTICLE 10 - ENFORCEMENT  

This contract shall enter into force when it is approved electronically by the Buyer.
